Welcome to The Tiny Clubhouse. We hope that you enjoy your visit and find that using our website to learn about The Tiny Clubhouse, our educational toys, and our product offerings is easy, productive, and fun.

Before using or registering with The Tiny Clubhouse website, please read the following Terms and Conditions ("Terms") carefully. These Terms govern your access to and use of The Tiny Clubhouse Online website and any products, services, software, tools, applications, features, or functionality offered or made available on or through the website (the "Site").

Your access to and use of the Site is expressly conditioned on your acceptance of and compliance with these Terms. If you do not accept these Terms, you will not be permitted to access or use the Site, and any violation of these Terms may result in termination of your ability to access and use the Site.

In order to use the Site, you must be at least 13 years of age. You represent that you are at least 13 years old. If you are not at least 13 years of age, please do not access, use, or register with the Site.

  2. Modify the Site, including eliminating or discontinuing any content or features.

As used in these Terms, "we," "our," "us," and "The Tiny Clubhouse" refer to The Tiny Clubhouse, including its subsidiaries and affiliates.


1. Registration

When setting up an account with us to place orders through the Site, you agree to:

  • Provide accurate, current, and complete information about yourself as prompted by our registration form (including your email address).
  • Maintain and update your information to keep it accurate, current, and complete.

If any information you provide is untrue, inaccurate, or incomplete, we reserve the right to terminate your access to the Site. Our use and disclosure of your information are governed by our Privacy Policy.

As part of the account setup, you may be asked to select a username and password. You are entirely responsible for maintaining the confidentiality of your credentials and for any activities conducted through your account.

Subject to compliance with these Terms, we grant you a limited, non-transferable right to access and use the Site solely for personal purposes. The Site, including all materials and intellectual property, remains the property of The Tiny Clubhouse or its licensors.

You represent and warrant that you own the necessary rights to your Submissions and that they do not infringe any third-party rights or violate applicable laws.

The Site may allow users to share content via forums. Opinions shared by forum participants are their own and not endorsed by The Tiny Clubhouse. We are not responsible for errors, omissions, or damages resulting from reliance on forum content.


5. Making Purchases

  • Your Submissions.

11. Disclaimer of Warranties

The Site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, The Tiny Clubhouse disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.


12. Limitation of Liability

To the extent permitted by law, The Tiny Clubhouse is not liable for damages arising from your use of the Site or inability to use it.


13. Exclusions and Limitations
Some jurisdictions do not allow the exclusion of certain warranties or the exclusions of certain liability limitations. Accordingly, some of the above limitations of Sections 14 (Indemnity), 15 (Disclaimer of Warranties), and 16 (Limitation of Liability) may not apply to you. In particular, if you are a resident of New Jersey, Sections 14, 15, and 16 of these Terms and Conditions shall not apply to you, notwithstanding anything to the contrary herein or in any linked, incorporated, or otherwise referenced document, policy, or terms and conditions.

14. Fraud Protection Program
As part of our order processing procedures, we screen all received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order, or our Sales Support department may call you at the phone number you provided (or use your email address) to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. These measures are taken to protect both our customers and ourselves from fraud or other unauthorized or illegal activity.

15. Policy for Idea Submission
Many customers express interest in submitting ideas and suggestions for products and services to The Tiny Clubhouse. While we appreciate these contributions, please note that any submitted ideas or suggestions will be owned by The Tiny Clubhouse, and you irrevocably assign any intellectual property rights in such ideas and suggestions to The Tiny Clubhouse. If the foregoing assignment is deemed ineffective, your ideas and suggestions will be treated as Submissions, subject to the license granted to The Tiny Clubhouse in Section 3 of these Terms. Do not submit ideas or suggestions if you intend to retain intellectual property rights unless you have prior written approval from The Tiny Clubhouse. If we are interested in pursuing your submission, we will contact you and may require an additional legal agreement.

16. Mobile Message Service Terms and Conditions
The Tiny Clubhouse mobile message service (the "Service") is operated by The Tiny Clubhouse. Your use of the Service constitutes agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. By consenting to the Service, you agree to receive recurring SMS/text messages from The Tiny Clubhouse at the number you provided, including service-related and promotional messages. Participation is voluntary and not a purchase condition. Message and data rates may apply. You may opt out at any time by texting STOP or following instructions specific to your region. The Service is subject to your wireless provider’s messaging rates, and carriers are not liable for delayed or undelivered messages.

17. Miscellaneous
These Terms are governed by the laws of California, United States. By agreeing to these Terms, you consent to the exclusive jurisdiction of State or Federal courts in San Francisco, California. If any provision is deemed unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and The Tiny Clubhouse regarding the subject matter and supersede prior agreements. 18. Tiny Clubhouse Mobile Messaging Program Overview

Tiny Clubhouse (hereinafter, "We," "Us," "Our") offers a mobile messaging program (the "Program"). Participation in this Program is subject to these Mobile Messaging Terms and Conditions and Privacy Policy (the "Agreement"). By opting into or participating in the Program, you agree to these terms, including binding, individual-only arbitration as detailed in the "Dispute Resolution" section below. This Agreement applies solely to the Program and does not alter other Terms and Conditions or Privacy Policies governing your relationship with Us.

19. User Opt-In

Users may opt into the Program via online forms or other enrollment methods. By opting in, you consent to receiving autodialed or prerecorded marketing messages at the number provided, with the understanding that consent is not required for purchases. Message and data rates may apply.

20. User Opt-Out

To discontinue participation, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any received mobile message. Other opt-out methods, such as verbal requests, are not valid. Upon opting out, you may receive a confirmation message.

21. Duty to Notify and Indemnify

If you change or discontinue the mobile number provided, you must complete the opt-out process first. Failure to notify Us of such changes may result in liability for any costs or claims incurred. You agree to indemnify Us for damages resulting from failure to provide updated contact information.

22. Program Description

Participants in the Program can expect to receive marketing messages about Tiny Clubhouse's products, services, and events.

23. Cost and Frequency

Message and data rates may apply. Messages are recurring, with additional messages based on user interaction.

24. Support Instructions

For support, text "HELP" to the sending number or email support@thetinyclubhouse.com. Opt-outs must follow the procedures outlined in #16.

25. MMS Disclosure

If your device does not support MMS, the Program will send SMS instead.

26. Disclaimer of Warranty

The Program is provided "as-is" and may not always be available. Tiny Clubhouse is not responsible for delays or failures in message delivery caused by external factors.

27. Participant Requirements

Participants must have a mobile device capable of two-way messaging, be a wireless service subscriber, and use a compatible carrier.

28. Age Restriction

Users under 13 years old cannot participate. Users aged 13–18 require parental or guardian consent.

29. Prohibited Content

Users are prohibited from sending the following through the Program:

  • Fraudulent or defamatory content
  • Objectionable or discriminatory content
  • Malware or harmful code
  • Illegal promotions
  • Protected health information under HIPAA

30. Dispute Resolution

Disputes related to the Program will be resolved by binding arbitration in Wilmington, Delaware, under the AAA's Commercial Arbitration Rules. Class arbitration is prohibited. The arbitration provision survives cancellation of participation in the Program.

31. Miscellaneous

You warrant that you have the authority to agree to these terms. Updates to this Agreement will be communicated to you, and continued participation implies acceptance.
